1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of Efsolit AI (the "Service"), provided by Efsolit Technology Private Limited ("Efsolit", "we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Efsolit AI is a software-as-a-service platform that helps businesses automate lead outreach using AI-generated email content. Depending on your configuration, the Service may send and receive email on your behalf via a connected Gmail account or a custom SMTP/IMAP mailbox, and may schedule meetings via Google Calendar.

3. Eligibility and Account Registration

You must be at least 18 years old and capable of forming a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when registering.

4. Connecting Third-Party Accounts

You may connect a Gmail account or a custom email account (SMTP/IMAP) to enable outreach features. By connecting a Gmail account, you authorize Efsolit AI to send email, read your inbox for the purpose of detecting lead replies, and create Calendar events on your behalf, strictly as described in our Privacy Policy. You may revoke this access at any time via your Google Account permissions or your Efsolit AI account settings; doing so may disable related features of the Service.

5. Your Content and Data

You retain ownership of the lead data, company information, and other content you upload to the Service ("Your Content"). You grant Efsolit AI a limited license to use Your Content solely to provide the Service to you, including generating AI-powered emails and processing replies on your behalf. You represent that you have the right to upload and use any lead or contact data you provide, and that your outreach activities comply with applicable anti-spam and data protection laws (such as CAN-SPAM, GDPR, or equivalent local regulations) in the jurisdictions where your leads are located.

6. Acceptable Use

You agree not to use the Service to:

• Send unsolicited bulk email (spam) or content that violates applicable anti-spam laws.
• Send fraudulent, deceptive, harassing, defamatory, or illegal content.
• Upload contact lists obtained without a lawful basis for outreach.
• Attempt to reverse-engineer, disrupt, or gain unauthorized access to the Service or its infrastructure.
• Use the Service in violation of Google's API Terms of Service or any connected third-party provider's terms.

7. Subscriptions and Billing

Access to certain features of the Service requires a paid subscription. Subscription fees are billed in advance on a recurring basis (monthly or as otherwise specified at checkout) and are processed via third-party payment gateways (such as Razorpay or PayPal). Each subscription plan includes a specified usage allowance ("credits") for AI-generated content; usage beyond your plan's allowance may require upgrading to a higher tier. Except where required by law, fees are non-refundable once a billing cycle has begun.

8. AI-Generated Content Disclaimer

The Service uses artificial intelligence to draft email content on your behalf. While we aim for high-quality, relevant output, we do not guarantee the accuracy, tone, or effectiveness of AI-generated content. You are responsible for reviewing outreach activity conducted through your account and for ensuring compliance with applicable laws and your own business standards.

9. Intellectual Property

The Service, including its software, design, and branding, is owned by Efsolit Technology Private Limited and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or proprietary technology beyond the limited right to use the Service as intended.

10. Third-Party Services

The Service integrates with third-party providers, including Google (Gmail, Calendar), OpenAI, and payment gateways. Your use of these integrations is also subject to the respective third party's own terms of service. Efsolit AI is not responsible for the availability, performance, or policies of these third-party services.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that outreach emails will achieve any particular result.

12. Limitation of Liability

To the maximum extent permitted by law, Efsolit Technology Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising from your use of or inability to use the Service, including any consequences of emails sent via your connected email account.

13. Indemnification

You agree to indemnify and hold harmless Efsolit Technology Private Limited from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party, including claims arising from outreach content sent through your account.

14. Termination

We may suspend or terminate your access to the Service at our discretion, including for violation of these Terms, non-payment, or abuse detected by our systems or by third-party providers such as Google. You may terminate your account at any time by contacting us or through your account settings.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. We will indicate the "Last updated" date at the top of this document.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles, unless otherwise required by applicable local law in your jurisdiction.
